Email Marketing the Law

This is a question we get asked a lot, can I legally email these companies?

The law says that you may market to a business via email as long as there is an unsubscribe option on the email. The email must also be considered relevant and not excessive (basically you shouldn't sent the same email more than once). For Business to consumer the law is very different and tricky and each case needs to be judged on its merits, if you want advice on this please do get in touch and we will try to help you where we can.

As a little check list to help you get started and make sure you are the right side of the law, you should be able to answer yes to the below questions, if you can you are well on your way to being compliant, but you may not be 100% compliant depending on your industry sector so please get in touch and we will put your mind at ease.

  • Do I really need this information about an individual?
  • Do I know what I'm going to use it for?
  • Do the people whose information I hold know that I've got it and are they likely to understand what it will be used for?
  • Am I satisfied the information is being held securely, whether it's on paper or on a computer? And what about my website? Is it secure?
  • Is access to personal information limited to those with a strict need to know?
  • Am I sure that the personal information is accurate and up to date?
  • Do I delete or destroy personal information as soon as I have no more need for it?
  • Have I trained my staff in their duties and responsibilities under the Data Protection Act, and are they putting them into practice?
